Membership Registration

Article 5 — According to Article 32 of the Law, those who are required to register with the exchanges must register with the exchange in their location within one month from the date they begin their business activities. The date of commencement is the date on which the purchase or sale transaction takes place.

Registration with the exchanges is done upon request. However, those who fail to fulfill the registration obligation as per the first paragraph of this article are subject to the provisions of Article 7 of these Regulations. For registration with the exchanges, individuals must be registered in the trade registry or in the tradesmen and craftsmen registry, and the activities listed in these registries must include the purchase or sale of commodities subject to exchange regulations. The provision in the third paragraph of Article 32 of the Law remains valid. These membership registrations, which are made according to professional groups, are kept up-to-date in the common database organized electronically within the Ministry and the Union.

Exchanges update their membership records every January in accordance with Article 32 of the Law. Accordingly, members whose addresses and status cannot be determined from the first day of January in the second year prior to the current year until the time the update is made, as well as those who have not conducted any transactions with exchange-listed commodities during this period, will have their membership suspended by a decision of the board, and they will not be able to benefit from exchange services. Members who register with the exchange after the first day of January in the second year prior to the current year are exempt from the provisions of the first paragraph of this article.

Members whose membership is suspended due to the absence of transactions with exchange-listed commodities or due to the inability to determine their address and status, will have their membership reinstated by a board decision if they provide evidence of transactions involving exchange-listed commodities or report their address and status. These members' names will be included in the relevant professional group and their membership dues will be reinstated. However, they will not be included in the voter list until they have paid all outstanding membership dues. Producers or manufacturers who sell their goods directly to consumers without producing in bulk or on a serial basis may sell their products at the exchange without registering with the exchange.

By registering the purchase and sale of agricultural and animal products with the exchange, the informal economy is brought under control, thereby preventing tax loss and evasion, including withholding tax (stopaj), VAT, and other tax-related issues in these products.

When the purchase and sale of agricultural and animal products are duly registered and recorded with the exchange, a 50% reduction in withholding tax is applied. This reduction in withholding tax helps mitigate the concealment of commercial profits arising from these transactions.
